Privacy policy on the processing of personal data pursuant to Regulation (EU) 2016/679 ('GDPR') and Legislative Decree 101/2018
Pursuant to Article 13 of Regulation (EU) 2016/679 on the protection of personal data ('GDPR'), we inform you that your personal data will be processed, both electronically and manually, in Italy and abroad, in compliance with the principles of lawfulness, fairness, transparency, and protection of your privacy and rights.
This policy, drawn up in accordance with the principle of transparency prescribed by the GDPR, is divided into sections to facilitate understanding.
1. Data Controller
The Data Controller is System Ceramics S.p.A. (hereinafter, the 'Data Controller'), with registered office at Via Ghiarola Vecchia no. 73, Fiorano Modenese (MO). For the purpose indicated in point 2.C, System Ceramics S.p.A. and certain third-party companies (business partners) will act as joint data controllers pursuant to Article 26 of the GDPR.
2. Purpose of the processing
Your personal data will be processed for the following purposes:
A) To respond to your requests and inquiries, as well as to fulfil accounting, tax, commercial, and legal obligations related to ongoing contractual relationships;
B) For the sending of informative, promotional material and advertising communications by System Ceramics S.p.A. via mail, email, telephone, fax, instant messaging or similar tools, subject to your explicit consent;
C) For the sending of informative, promotional material and advertising communications by third-party companies (business partners of System Ceramics S.p.A.), including those located outside the EU, using the same channels as above, subject to your explicit consent.
3. Legal basis for the processing
- For the purpose described in points 2.A, processing is necessary for the performance of the contract; providing your data is mandatory, and failure to do so will make it impossible to provide the requested services.
- For the purposes described in points 2.B and 2.C, processing is based on your explicit consent, which is optional and may be revoked at any time without affecting the lawfulness of the processing carried out before revocation.
4. Data disclosure
Your personal data may be disclosed to third parties assigned with data processing and to partner companies of System Ceramics S.p.A., with which data may be shared for the purposes described above, in compliance with current regulations.
5. Data retention period
Data will be retained for as long as strictly necessary to achieve the purposes set out in point 2.A and, in any case, until the termination of the contractual relationship, unless additional legal obligations apply. For the purposes set out in points 2.B and 2.C, data will be stored until you revoke your consent.
6. Territorial scope of the processing
Data will mainly be processed within the European Union. Should it be necessary to transfer data outside the EU, all safeguards required by the GDPR will be adopted.
7. Data subject’s rights
Pursuant to Articles 15 et seq. of the GDPR, you have the right to:
- obtain confirmation of whether your personal data is being processed and access such data;
- request the correction or deletion of inaccurate or unlawfully processed data;
- request the restriction of processing;
- exercise the right to data portability;
- object to processing for legitimate reasons or for direct marketing purposes;
- withdraw consent at any time, without affecting the lawfulness of the processing based on consent before withdrawal;
- lodge a complaint with the Italian Data Protection Authority.
